The following are terms and conditions for the use of Black Rabbit Service Co. services. Please read them carefully. Our service is offered to you with the condition that you accept without modification the terms and conditions contained herein. Black Rabbit Service Co. may change these terms of service at any time, with or without notice. By obtaining services from Black Rabbit Service Co., you are indicating your agreement to be bound by all of the terms and conditions set forth in this document.

 

These terms and conditions state important requirements regarding your use of Black Rabbit Service Co. services. You should read them carefully as they contain important information regarding your rights and ours.

 

  1. General

These terms of service are entered into by and between you, the customer (personally and/or on behalf of your employer, as applicable) and Black Rabbit Service Co. you are deemed to have accepted this agreement upon the earlier of: (I) your submission of an online or telephone request for service; (II) your on-site; or (III) your use of the service. This agreement is made up of the terms below, all attachments to this agreement, and the other policies and materials specifically referred to in these terms of services.

 

  1. Definition of service

For purposes of this agreement, the term "service" shall mean Black Rabbit Service Co. services, including all technical support provided by Black Rabbit Service Co. under the service option that you have selected. The service may be referred to as “repair(s)”, “technical problem(s)”, "technical support", "technical service(s)" or "technical repair service(s)"

 

  1. Pricing and payments

Black Rabbit Service Co. fees and charges for the service you select are provided to you on the prior page and are provided upon your request. You agree to pay the charges applicable to your selected service, as well as any applicable taxes and other charges including but not limited to initial fees. All customers must have a credit card on file before we will schedule any services. You also agree to pay any additional fees or charges applied to your billing account for any reason, including but not limited to, interest and charges due to insufficient credit or insufficient funds.

 

3.1. Black Rabbit Service Co. will make every reasonable attempt to analyze, assess, correct, or otherwise fix your machine or other problem. If Black Rabbit Service Co. are unable to resolve your technical problem (e.g. if it turns out to require discontinued or otherwise unobtainable parts), you may still be liable for charges for time spent by Black Rabbit Service Co. in an attempt to correct a problem.

 

3.2. All payments are expected to be collected at completion of a service visit. The technician will calculate the total amount due based on the travel fee, labor rate and any parts used. Upon completing the repairs, the technician(s) will explain to the customer what has been done and demonstrate that the problem described by the customer prior to the start of the repairs has been fixed.

 

3.3. If a technician discovers an unforeseen technical problem which requires additional cost to fix and the customer declines the repairs, the payment for the original service is expected as calculated by the technician using the fixed rate.

 

3.4. Applicable travel and labor rates are determined by the address 6322 NE Halsey St, Portland OR 97213, the fixed point of origin of Black Rabbit Service Co, to the client's address.

 

3.5. Travel fees to be applied once per round-trip between the location of Black Rabbit Service Co. and the location of the client.


3.6. Any duration of time between 1 and 60 minutes upon arrival at client's location by Black Rabbit Service Co. is considered the "first hour" and is subject to full applicable hourly labor charges.

 

3.7. After the “first hour”, additional labor rates are billed by half hour increments. Each 1-30 minutes of additional labor time will be charged as one half of the dollar amount of the client's applicable hourly labor rate.

 

3.8. All pricing on Black Rabbit Service Co. "service rates" document pertain to technical services performed by Black Rabbit Service Co. and can include or exclude the following: sales, parts, installation, consultation, or any other type of service determined by Black Rabbit Service Co.

 

3.9. All labor rates are subject to change without prior notice.

 

  1. Limitation on liability

In no event shall Black Rabbit Service Co. and/or its respective suppliers be liable for any consequential direct, incidental, indirect, punitive, special or other similar damages or any damages resulting from loss of use, whether in an action of contract. Negligence or other action. Arising out of or in connection with the use of performance of materials and services available from the site, even if the possibility of such damages could have been foreseen by Black Rabbit Service Co. Black Rabbit Service Co. is not responsible for any injuries sustained by users because of or as a result of any service.

 

Black Rabbit Service Co. reserves the right to revise, amend or modify these terms of service and our other policies and agreements at any time and in any manner.
